Terms And Conditions of Sale
Order Information: Feel free to place an order by
telephone, fax or email. Be sure when ordering that all necessary
information regarding finish colors are included in the purchase
order. We will fax, email or US mail an order acknowledgement to
you to confirm all the details of the order.
Payment: We require a minimum fifty percent deposit on all orders
over five hundred dollars. The balance, inclusive of shipping costs,
must be paid prior to shipment. Payment may be charged on a Visa,
MasterCard, American Express, Discover or Diners Club
account. Checks and COD orders are accepted as well.
Acknowledgment: Orders and terms of payment are subject to the
approval of our sales department. No order shall be considered accepted
until officially acknowledged by Derek Marshall Company. Any additional
or different terms appearing on the acknowledgment but not included on
the order shall be deemed accepted if Derek Marshall Company is not
notified in writing within ten working days.
Prices: All prices are quoted F.O.B. Sandwich, New Hampshire, USA
and are subject to change without prior notice. Prices are for products
as illustrated and described in the catalog and on the web page. Other
options may increase or decrease that price. All price quotations expire
within 60 days from the date of the quotation unless otherwise
expressed.
Shipping Information: All items are shipped F.O.B. Sandwich, NH,
USA. If purchaser does not specify the type of shipping, we reserve the
right to ship by whichever means we consider appropriate. All shipments
are fully insured against loss or breakage.
Claims: Derek Marshall Company is not responsible for any damage
which occurs in transit or storage. It is the customer's responsibility
to examine the merchandise upon receipt and notify both us and the
carrier of loss or damage.
Storage: If the customer requests a postponement of delivery when
Derek Marshall Company is ready to make shipment, we reserve the right
to transfer the merchandise to storage at the customer's risk and
expense. Such transfer to storage shall be deemed delivery to the
customer for all purposes, including invoicing and payment.
Cancellation/Return: All our products are made to customer
specifications and no order accepted by us is subject to cancellation.
Specifications: We reserve the right to alter or modify
specifications and designs of our products as necessary. Some variation
in finish specifications may occur due to the nature of the finishing
process.
Lamps: We can provide compact fluorescent or halogen bulbs for
our fixtures upon request. Please call for details and additional
charges.
UL: All our products are registered with Underwriters
Laboratories, Inc., and are so labeled for damp location.
ADA: Most of our designs comply with the Americans with
Disabilities Act requirements for public spaces and are so marked in our
catalog.
Warranty: Derek Marshall Company warrants its products against
defects in material and workmanship. We will repair or replace any
lighting product which fails under normal operating conditions within
three years from the date of shipment. This warranty is conditional upon
written authorization from Derek Marshall Company concerning the
replacement or repair.
